Report into Bullying in WorkCover released

The Inquiry into Bullying and Harassment in WorkCover released in March by PwC found that over 40% of the workforce believed they had been bullied or harassed: "Bullying and harassment by a manager or supervisor most commonly occurred in the form of nit-picking, unjustified criticisms or inequitable treatment compared to other employees," the report said.There were also "a number of examples" of bullying complaints being "poorly handled".PwC found that, in the case of five specific allegations, WorkCover "failed" to investigate in time and failed to clarify the complaint at the time of reporting.

It noted that there was a lack of grievance training for managers responsible for investigating allegations and that management had failed to communicate properly with the people involved.

FWA Dairy Farmers Case

Fair Work Australia up held the sacking of seven Dairy Farmers employees last month despite a culture of employees exchanging pornographic and racist emails. The employees were amongst 15 employees who exchanged inappropriate emails and were dismissed or resigned following an investigation. The court determined that even if over 50% of the workforce had accessed the offensive material "this cannot ....be used as a defence of the applicants' behaviour" and that blame 'could not be laid at the [company's] door'.

The Brodie Laws VICTORIA

In April 2011, the Victorian Government introduced legislative amendments to the stalking laws to criminalise the full range of serious bullying cases, including serious workplace bullying. The effect of these changes is that bullies in Victoria could face up to 10 years jail.
